Terms & conditions
These terms cover the use of this website and the design and development work 201 studio carries out for clients. 201 studio is a web design and development studio based in Auckland, New Zealand. By using this site or engaging us for work, you agree to what follows. Everything on this website — the writing, layout, code, imagery and the 201 studio name and mark — belongs to us, except client logos shown with permission. You are welcome to read, share and link to it. You may not copy it, resell it or pass it off as your own. We keep this site accurate and available as best we can, but we do not promise it will be uninterrupted or error-free, and the content here is general information rather than advice for your particular situation. Prices shown on this site are a guide and include GST. The terms that actually bind us are the ones in the written quote we send you: the scope, the price, what is included and what is not. A quote is valid for 30 days and a project starts once you accept it in writing. Payment terms, including any deposit and when the balance falls due, are set out in your quote and on each invoice. Work may pause on overdue accounts, and final files, domains and hosting transfer once the account is settled in full. Revisions and turnaround times are as described on the pricing section of this site and confirmed in your quote. Revisions cover refining the work we agreed — copy, layout and direction. A change to the agreed scope, such as extra pages or a new brief, is quoted separately before we start it. Our turnaround depends on getting what we need from you. If a project stalls waiting on content or feedback for more than 30 days, we may put it on hold and reschedule it around other work. How much you hand over is up to you. Send us the copy, images and logos you already have, or send us nothing and we will design around it — either is fine. Where you do supply content, you confirm you have the right to use it, and we are not liable for claims arising from material you give us. Once your account is paid in full, you own the final designs and the code we deliver for your project. We keep ownership of our own tools, templates and underlying know-how, and we may show the finished work in our portfolio and on social media unless you ask us in writing not to. Where a package includes a domain or hosting, the included period and what happens after it are set out in your quote. Third-party services such as domain registrars, hosting providers and email services are governed by their own terms, and we are not responsible for their outages, price changes or policies. Either of us can end a project in writing. If you cancel, you pay for the work completed up to that point and any non-refundable costs already incurred on your behalf. If we cancel — unlikely, but possible — we will tell you as early as we can so you have time to line up another studio without losing weeks, hand over what has been done, and refund anything paid for work not yet completed. We do our work carefully and to a professional standard, but to the extent the law allows, our total liability for any claim relating to a project is limited to the amount you paid us for it, and we are not liable for indirect or consequential loss such as lost profits or lost data. Nothing here limits rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those apply. These terms are governed by New Zealand law and the New Zealand courts. If we change them we will update this page and change the date above; the version that applies to your project is the one current when you accepted your quote.
